Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rooted mobile applications, website, and related products and services operated by Rooted App, LLC, a Missouri limited liability company ("Rooted," "we," "us," or "our").
Please read these Terms carefully. By creating an account, accessing or using Rooted, purchasing a membership, or otherwise using our services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not access or use Rooted.
1. About Rooted
Rooted is a Christian Bible-reading, devotional, prayer, journaling, gratitude, community, and spiritual-growth service designed to help users engage with Scripture and support real-world impact initiatives.
Rooted may be available through:
- the Rooted iOS application;
- the Rooted Android application;
- rootedapp.faith; and
- other Rooted-operated user-facing services that we may introduce in the future.
These Terms apply to Rooted's user-facing services generally unless separate terms are presented for a particular product or feature.
Rooted App, LLC operates from the United States. Rooted may be available to users internationally, subject to applicable laws, platform availability, and any geographic restrictions imposed by Rooted, Apple, Google, or another applicable service provider. Rooted is not currently offered in the European Economic Area (EEA), the United Kingdom, or Russia.
2. Eligibility and Age Requirements
You must be at least 13 years old to create or use a Rooted account.
If you are under the age of legal majority where you live, you represent that you have permission from your parent or legal guardian to use Rooted and to agree to these Terms.
Where applicable law requires a higher minimum age, parental authorization, or another form of consent before you may use the Service or provide personal information, those requirements also apply.
Rooted is not directed to children under 13 and does not permit children under 13 to create accounts.
You may not use Rooted if applicable law prohibits you from doing so.
3. Accounts
A Rooted account is required to use Rooted.
Depending on the options available to you, you may create or access an account using methods such as:
- email authentication;
- Sign in with Apple; or
- Sign in with Google.
You agree to provide accurate information and to keep information associated with your account reasonably current.
Rooted may collect your name, and you may also be permitted to choose a separate display name. Your display name does not have to be your legal or real name, but you may not use a name intended to impersonate another person, mislead other users, or violate another person's rights.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity that occurs through your account.
You may not sell, transfer, share, or permit unauthorized use of your Rooted account.
You must notify us promptly at [email protected] if you believe your account has been compromised.
4. Privacy
Our collection, use, storage, sharing, and protection of personal information is described in the Rooted Privacy Policy.
By using Rooted, you acknowledge that information will be handled as described in that Privacy Policy.
Certain Rooted features involve information that may be religious, devotional, or otherwise personal in nature, including journal entries, prayers, gratitude entries, answered prayers, and Bible-reading activity. Please review the Privacy Policy carefully for information regarding how that information is handled.
5. Memberships and Subscriptions
Rooted may offer paid membership levels, including membership tiers known as Rooted, Overflow, and Multiply, or successor membership plans.
The features, impact benefits, pricing, and billing period applicable to a membership will be displayed before purchase.
Rooted may offer monthly, annual, or other subscription periods.
Subscriptions purchased through the Apple App Store are processed by Apple. Subscriptions purchased through Google Play are processed by Google. Rooted may use third-party subscription management services to verify purchases and determine membership entitlements.
Rooted does not directly receive or store your complete credit card number, banking information, or other payment credentials for purchases processed through Apple or Google.
Automatic Renewal
Paid subscriptions automatically renew unless cancelled before the applicable renewal date.
When you purchase an automatically renewing subscription, you authorize the applicable app store or payment provider to charge the applicable subscription price at each renewal until you cancel.
Your subscription price, renewal date, applicable taxes, billing procedures, and other payment details may be governed by the platform through which you purchased your subscription.
Free Trials
Eligible users may receive a 3-day free trial of a Rooted paid membership when offered.
Unless otherwise expressly stated in the offer presented to you:
- a user may receive a Rooted free trial only once;
- the free trial applies to eligible paid membership offerings; and
- the subscription automatically converts to the applicable paid subscription when the trial ends unless it is cancelled before the trial expires.
Eligibility and processing may also depend on Apple, Google, or another applicable platform's systems and rules.
Cancellation
You may cancel an App Store or Google Play subscription through the subscription-management settings provided by Apple or Google.
Cancellation generally prevents future renewals but does not retroactively terminate a subscription period for which payment has already been processed, except where required by law or applicable platform rules.
Upgrades and Downgrades
If you upgrade or downgrade your membership, the timing of the change, prorated charges or credits, billing adjustments, and effective date may be determined by Apple, Google, or the applicable payment provider.
Where supported by the applicable platform, downgrades generally take effect on a future renewal date.
Refunds
Purchases made through Apple's App Store or Google Play are subject to the applicable platform's refund procedures and policies.
Rooted generally does not directly issue refunds for transactions processed by Apple or Google, except where required by applicable law.
Price and Membership Changes
Rooted may change subscription prices or modify the features included with a membership tier in the future, subject to applicable law, required notice, and applicable app-store requirements.
Legitimately earned or fulfilled impact will not be arbitrarily removed solely because Rooted later changes its membership structure.
6. Account Deletion
You may request deletion of your Rooted account through the account-deletion functionality available within Rooted or through the external account-deletion process provided on our website.
When a valid account-deletion request is completed, ordinary account information and user content associated with the account, including challenge comments, messages, and similar community content, are deleted from Rooted's active systems in accordance with our Privacy Policy.
Deleted information may remain temporarily in secure system backups for up to approximately 30 days before those backups are overwritten through ordinary backup-retention processes.
Rooted may retain limited information when reasonably necessary for purposes such as:
- compliance with legal obligations;
- financial reporting and accounting;
- fraud or security prevention;
- subscription and transaction disputes;
- chargeback or refund administration;
- impact accounting and substantiation; or
- enforcing or defending legal rights.
Rooted may also retain information that has been aggregated or de-identified so that it no longer reasonably identifies you.
Where available, you may request or use applicable account-data export features before deleting your account.
Deleting Your Rooted Account Does Not Cancel Your Subscription
Deleting your Rooted account does not automatically cancel an active Apple App Store or Google Play subscription.
Apple and Google control subscriptions purchased through their respective platforms.
You are responsible for separately cancelling your subscription through the applicable Apple App Store or Google Play subscription settings if you want to prevent future subscription charges.
7. Rooted's Real-World Impact Program
Rooted is designed to connect engagement with the Service to real-world impact initiatives involving areas such as tree planting, meal assistance, and clean-water initiatives.
Rooted may describe these programs using names such as:
- The Vine — Trees
- Bread of Life — Meals
- Living Water — Clean Water
The availability, names, mechanics, and requirements of these programs may change over time.
Rooted Funds the Impact
Impact represented within Rooted is funded or carried out by Rooted, which may use revenue from membership purchases and other Rooted funds to support these initiatives.
A Rooted membership is a purchase of Rooted's app and membership services. It is not a charitable donation.
Payments made to Rooted are not donations to a charity and are not represented by Rooted as tax-deductible charitable contributions.
Your membership payment is not an individual charitable contribution earmarked by you for a particular organization, tree, meal, water project, person, or geographic location.
How Impact May Be Fulfilled
Rooted may fulfill impact by:
- providing funding to carefully vetted charitable or nonprofit organizations;
- funding qualifying initiatives operated by third parties; or
- funding, organizing, or carrying out qualifying activities directly through Rooted.
Rooted may use different organizations, projects, locations, or fulfillment methods at different times.
Rooted is not required to publicly disclose every organization, vendor, project, or operational relationship used to carry out its impact initiatives.
Trees
A tree represented in Rooted corresponds to a real-world tree-planting commitment funded or carried out by Rooted.
When Rooted uses an outside organization, Rooted may calculate tree impact using the amount Rooted contributed together with a documented, publicly available donation-to-impact metric published by that organization.
Donation documentation may reflect the amount contributed rather than identifying a particular physical tree assigned to an individual Rooted user.
When Rooted fulfills tree-planting impact directly, Rooted maintains appropriate records regarding the activity and associated costs.
Meals
A "meal provided" represents food assistance equivalent to one meal based on a documented and reasonably supportable impact metric or comparable documented cost basis.
Rooted may fulfill meal impact through a vetted charitable organization or through qualifying activities directly funded or carried out by Rooted.
When an outside charitable organization is used, that organization is responsible for the ultimate purchasing, provision, or distribution of the applicable food assistance.
Clean Water
Clean-water impact may be represented in gallons.
When an outside charitable organization is used, Rooted may calculate the gallons represented by its contribution using that organization's documented donation-to-clean-water metric.
Rooted may also fund or carry out qualifying clean-water initiatives directly using a comparable documented methodology.
Timing of Impact
An impact celebration, milestone, counter, animation, or similar display within Rooted represents Rooted's commitment to fund or carry out the stated impact.
It does not necessarily mean that a particular physical tree has been planted, meal distributed, or gallon of clean water delivered at the exact moment the milestone appears in the app.
Rooted may aggregate impact obligations and fund or carry out impact on a periodic basis. As a result, there may be a reasonable period between an in-app impact milestone and completion of the corresponding real-world activity.
Partner and Project Changes
Rooted retains discretion regarding:
- which qualified impact partners or organizations it works with;
- project locations;
- particular projects;
- the timing of funding;
- how impact is fulfilled; and
- whether qualifying impact is carried out by Rooted directly.
If a particular organization or project becomes unavailable, Rooted may use another qualified organization or project.
If the exact originally contemplated form of fulfillment becomes impracticable, unavailable, unlawful, or commercially unreasonable, Rooted may provide a reasonably equivalent form of real-world impact.
No Cash Value
Impact milestones, credits, counters, trees, meals, gallons, or similar in-app impact representations:
- have no cash value;
- are not transferable;
- cannot be withdrawn;
- cannot be exchanged for subscription credit;
- are not currency or stored value; and
- do not create an ownership interest in any charitable organization, project, property, tree, food item, water system, or other underlying asset.
Refunds, Chargebacks, and Fraud
If a subscription payment is refunded, reversed, charged back, fraudulent, unauthorized, or otherwise invalidated, Rooted may reverse or withhold associated impact that has not yet been fulfilled.
Impact that Rooted has already funded or validly carried out will generally not be reversed solely because a user later cancels a subscription.
8. Impact Integrity and Abuse Prevention
Rooted relies on genuine user participation to operate its impact program fairly.
You agree not to falsely represent Bible reading, devotional participation, activity, referrals, or other qualifying actions for the purpose of artificially generating impact, rewards, statistics, or leaderboard activity.
For example, intentionally marking Scripture as completed when you did not actually complete the applicable activity may violate these Terms.
Rooted may use automated or manual safeguards designed to identify fraud, abuse, unusual activity, bot-like behavior, duplicate activity, or exploitation of Rooted's systems.
Rooted may:
- reject suspicious activity;
- correct inaccurate activity or impact totals;
- remove fraudulent activity;
- rate-limit activity;
- change fraud or abuse-prevention mechanisms;
- withhold impact generated through exploits or manipulation; and
- suspend or terminate accounts involved in material abuse.
Rooted may change the requirements or mechanics for earning future impact, including in response to operating costs, partner changes, misuse, program sustainability, or other legitimate business considerations.
Previously completed legitimate impact will not be retroactively invalidated merely because Rooted later changes the requirements for future impact.
9. Challenges and Community Features
Rooted may allow users to create or join shared Bible-reading challenges, groups, or similar community experiences.
Challenge features may include:
- participant profiles;
- group progress;
- challenge codes;
- leaderboards or statistics;
- comments or messages;
- challenge images or header photographs; and
- challenge administrators.
Challenge Visibility
Other challenge participants may be able to see information such as your:
- display name;
- profile image; and
- date you joined the challenge.
Members may also see aggregate group-level information, such as total books read or overall challenge progress.
Ordinary challenge members do not receive another user's individual impact contribution or individual progress solely through aggregate group statistics.
Challenge administrators may be able to see limited individual activity information necessary to administer the challenge, including a user's Active Days and number of books read.
Challenge administrators do not receive individual users' private impact contribution details through these administrative features.
Private journal entries, prayers, gratitude entries, answered-prayer content, and similar private content are not shared with challenge members or challenge administrators.
Challenge Content and Messages
Content you intentionally post to a challenge's shared features—including comments, messages, challenge names, or uploaded challenge images—is not private content and may be visible to other participants in that challenge.
Do not post information to a community area that you do not want other authorized participants to see.
Rooted may access, review, restrict, hide, or remove community content when reasonably necessary to operate the Service, respond to reports, enforce these Terms, protect users, or comply with law.
Challenge Administration
Challenge creators may be permitted to appoint other administrators and remove participants.
Rooted may remove users from challenges, remove or restrict challenge administrators, rename or remove challenges, or restrict community content when reasonably necessary to enforce these Terms or protect the Service.
Challenge administrators and other users are independent users of Rooted. Rooted does not control and is not responsible for every statement, representation, opinion, action, or decision made by another user, church, ministry leader, challenge creator, or challenge administrator.
Statistics and Leaderboards
Challenge statistics, leaderboards, activity totals, and progress indicators are provided for informational and engagement purposes.
They may be corrected when Rooted identifies synchronization issues, software errors, duplicated activity, inaccurate data, fraud, or abuse.
10. Ministry Codes
Rooted may provide codes associated with churches, ministries, organizations, or particular challenges ("Ministry Codes").
Entering a Ministry Code may automatically join your Rooted account to the challenge or community experience associated with that code.
By using a Ministry Code, you understand that the ordinary challenge visibility rules described in these Terms will apply to your participation.
A ministry or organization does not necessarily receive a separate list containing personally identifiable information solely because users redeemed its Ministry Code. However, authorized challenge administrators may see the limited participant information and activity information normally available to administrators within the associated Rooted challenge.
Ministry Codes:
- may expire;
- may be changed or discontinued;
- may be limited in availability or use;
- have no cash value; and
- may be invalidated if Rooted determines they were obtained or used fraudulently or in violation of these Terms.
The inclusion of a church, ministry, organization, or Ministry Code within Rooted does not mean that Rooted endorses every belief, teaching, statement, practice, individual, or action associated with that organization.
11. Referrals and Mission Partner Codes
Rooted may offer referral codes, invitation codes, Mission Partner codes, or similar programs.
Under certain referral programs, a qualifying referral may result in a joint impact reward, such as a tree represented for both the referring user and the newly referred user.
Eligibility requirements may apply.
Unless Rooted states otherwise, only one qualifying referral or Mission Partner code may be associated with an account for a particular promotion or qualifying event.
Rooted may deny, revoke, correct, or withhold referral benefits associated with:
- fake accounts;
- duplicate accounts;
- self-referrals;
- automated activity;
- bots;
- fraudulent transactions;
- chargebacks;
- abuse of promotional systems; or
- other violations of these Terms.
Referral or impact rewards have no cash value unless Rooted expressly states otherwise in a separate written agreement.
Mission Partners, influencers, creators, or other commercial partners may be subject to separate agreements with Rooted. Those separate agreements, rather than these consumer Terms, govern any commissions or compensation payable to those partners.
12. Private Journals, Prayers, Gratitude, and Other User Content
Rooted may allow you to create and store content such as:
- journal entries;
- prayers;
- answered prayers;
- gratitude entries; and
- personal notes.
These features are intended to be private unless Rooted clearly identifies a feature as shared and you intentionally choose to use that shared feature.
Rooted does not routinely review private journals, prayers, gratitude entries, or similar private content.
Access to such content is restricted and may occur only when reasonably necessary to:
- provide support that you request;
- operate or protect the Service;
- maintain security;
- investigate technical issues;
- comply with applicable law or valid legal process; or
- protect the rights, safety, and integrity of Rooted, our users, or others.

13. Ownership of Your Content
As between you and Rooted, you retain ownership of original content you create and submit to Rooted.
You grant Rooted a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, back up, and display your content to the extent reasonably necessary to provide, secure, maintain, and improve the functionality you request from the Service.
For private content, this license is limited to operating the applicable private features and related infrastructure.
For content you intentionally submit to a shared challenge or community feature, the license also includes displaying that content to the users with whom the applicable feature is designed to share it.
This license does not transfer ownership of your original content to Rooted.
You represent that you have the rights necessary to submit content to Rooted and that your content does not violate applicable law or another person's rights.
14. Community Content Standards
You may not use challenge names, comments, messages, profile content, images, or other shared Rooted features to submit or distribute content that:
- harasses, bullies, stalks, threatens, or abuses another person, or encourages targeted harassment;
- promotes hatred, dehumanization, or unlawful discrimination against a person or group based on protected characteristics;
- contains pornographic, sexually explicit, sexually exploitative, or child sexual abuse or exploitation material;
- threatens, incites, glorifies, or encourages violence or credible physical harm;
- encourages, instructs, or facilitates suicide, self-harm, dangerous acts, or other conduct likely to cause serious injury;
- reveals another person's private, confidential, or identifying information without authorization, including doxxing or other serious invasions of privacy;
- facilitates illegal conduct or solicits, offers, or promotes unlawful goods or services;
- impersonates another person or organization, or is intentionally deceptive or fraudulent;
- constitutes spam, scams, deceptive promotion, malware, malicious code, or attempts to compromise accounts or systems;
- infringes copyrights, trademarks, privacy rights, publicity rights, or other rights of another person; or
- otherwise violates applicable law, these Terms, applicable platform content or safety requirements, or materially interferes with the safety or operation of Rooted.
Rooted provides in-app tools that allow users to report objectionable community content or abusive users and to block other users. Rooted may use automated filtering, technical safeguards, and manual moderation to detect, limit, review, or remove content that may violate these standards.
Rooted may remove or restrict content, disable shared features, limit visibility, suspend or terminate accounts, or take other reasonable action when content or conduct violates these standards or creates a safety, security, legal, or platform-compliance risk.
15. Scripture, Bible Translations, and Third-Party Content
Rooted may provide Scripture and related materials using Bible translations such as:

- Other translations or materials Rooted may lawfully make available, subject to applicable copyright, trademark, licensing, and attribution requirements.
Certain Bible translations and other content are owned by third-party rights holders and are licensed to Rooted.
Other materials may be in the public domain.
Applicable copyright notices, attribution requirements, or license information may be displayed in Rooted or in accompanying legal notices.
Your access to licensed content through Rooted does not transfer ownership of that content to you.
Except where applicable law permits otherwise, you may not scrape, systematically extract, bulk download, reproduce, sell, republish, distribute, or commercially exploit copyrighted Bible translations or other licensed Rooted content without authorization from the applicable rights holder.
Rooted may add or remove Bible translations or other third-party content if licensing rights, technology providers, business circumstances, or legal requirements change.
16. Christian and Devotional Content
Rooted provides Scripture, devotionals, reading plans, prayer tools, journaling tools, and other Christian resources for informational, devotional, and spiritual-growth purposes.
Rooted is not a church and does not replace participation in a local church, pastoral care, clergy, counseling, or other qualified professional assistance.
Rooted's original devotionals, reading plans, commentary, or other faith-based content may reflect particular Christian perspectives or interpretations. Users may hold different theological or doctrinal views.
Rooted may separately publish a Statement of Faith. Use of Rooted does not, by itself, require you to personally affirm or adopt every statement in that Statement of Faith.
17. No Professional Advice
Rooted is not a medical, mental-health, legal, financial, or emergency-services provider.
Information or devotional content available through Rooted is not professional medical, mental-health, legal, or financial advice and should not be treated as a substitute for qualified professional assistance.
If you believe you are experiencing an emergency or need professional assistance, contact an appropriate qualified professional or emergency service.
18. Rooted Intellectual Property
Except for user content and third-party materials, Rooted App, LLC owns or licenses the rights associated with the Rooted Service, including as applicable:
- the Rooted name and branding;
- logos;
- software;
- source and object code;
- application design;
- interfaces;
- graphics and illustrations;
- original devotionals;
- original reading plans;
- impact-system design;
- written content; and
- other Rooted-created materials.
Subject to these Terms, Rooted grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own noncommercial purposes.
No rights are granted except those expressly stated in these Terms.
You may not commercially copy, sell, sublicense, redistribute, or exploit Rooted's proprietary content or technology without written permission.
19. Acceptable Use
You may not:
- hack, attack, disrupt, overload, or interfere with Rooted;
- attempt unauthorized access to accounts, databases, infrastructure, or systems;
- bypass or circumvent access controls;
- circumvent subscription or membership restrictions;
- reverse engineer the Service except to the limited extent such a restriction is prohibited by applicable law;
- scrape or systematically extract Rooted content;
- upload or distribute malware;
- use bots, scripts, or automation to fabricate activity;
- manipulate impact credits or statistics;
- manipulate leaderboards or reading activity;
- exploit referral or Mission Partner programs;
- create fraudulent or duplicate accounts for improper purposes;
- impersonate another person, Rooted, or a Rooted representative;
- violate intellectual-property or privacy rights;
- harass or abuse other users;
- resell Rooted without authorization;
- use Rooted's name or logo without authorization; or
- use Rooted for illegal purposes.
Rooted may take reasonable technical and account-level measures to prevent or respond to prohibited activity.
20. Communications
Rooted may communicate with you through email, push notifications, in-app messages, and other service-related communications.
Communications may include:
- account and security messages;
- authentication communications;
- subscription information;
- Bible-reading reminders;
- challenge notifications;
- impact updates and celebrations;
- monthly impact information or videos;
- service announcements; and
- marketing communications.
You may opt out of marketing emails using the unsubscribe functionality provided in those messages.
You may generally manage push-notification permissions through Rooted or your device settings.
Opting out of marketing communications does not prevent Rooted from sending communications reasonably necessary to administer your account, provide the Service, address security issues, or fulfill legal obligations.
Rooted does not currently use SMS text messaging as a standard communication channel.
21. Third-Party Services
Rooted depends on third-party platforms and service providers to operate portions of the Service.
These may include providers responsible for:
- app distribution;
- authentication;
- database and cloud infrastructure;
- subscription management;
- analytics;
- notifications;
- email delivery;
- error monitoring;
- Bible content or APIs; and
- other technical or operational functions.
Third-party products and services may be governed by their own agreements and privacy policies.
Rooted may change service providers without amending these Terms each time, provided our use of service providers remains consistent with applicable law and our Privacy Policy.
Rooted is not responsible for outages, failures, policy changes, or actions of third-party services outside Rooted's reasonable control.
22. Apple App Store and Google Play
If you obtain Rooted through Apple's App Store, your licensed use of the iOS application may also be subject to Apple's applicable Standard End User License Agreement and App Store terms.
If you obtain Rooted through Google Play, your use of the Android application and purchases through Google Play are also subject to applicable Google Play terms and policies.
Apple and Google are not responsible for operating or providing Rooted's services, content, user support, impact programs, or community features except to the extent an applicable platform agreement or law expressly provides otherwise.
Rooted, not Apple or Google, is responsible for the Rooted Service itself.
23. Changes to the Service
Rooted is an evolving product.
We may add, modify, redesign, restrict, replace, or discontinue features of Rooted from time to time.
This may include changes to:
- features;
- membership benefits;
- reading tools;
- community functionality;
- impact mechanics;
- impact partners;
- Bible translations;
- user interfaces; and
- other portions of the Service.
Rooted may discontinue all or part of the Service where reasonably necessary, subject to applicable consumer-protection, subscription, and other laws.
24. Availability, Bugs, and Downtime
Rooted does not guarantee that the Service will:
- operate without interruption;
- be free from bugs or errors;
- remain available at all times;
- be compatible with every device or operating system;
- permanently retain every feature; or
- permanently provide every Bible translation or third-party integration.
Maintenance, technical problems, service-provider outages, security events, app-store requirements, network failures, or other circumstances may temporarily affect availability.
25. Suspension and Termination
Rooted may restrict, suspend, or terminate an account when we reasonably believe the user has engaged in:
- a material violation of these Terms;
- fraud;
- abuse;
- security threats;
- illegal activity;
- manipulation of impact;
- harassment;
- repeated intellectual-property infringement; or
- conduct that materially threatens Rooted or its users.
Rooted may temporarily restrict an account while investigating suspected abuse, fraud, security issues, or other violations.
Where reasonably necessary, Rooted may suspend or terminate an account with or without advance notice, subject to applicable law.
If an account is terminated for serious misconduct, the user may lose access to the account and associated content.
Sections of these Terms that by their nature should continue after termination—including provisions concerning intellectual property, disclaimers, limitations of liability, dispute resolution, and other accrued rights—will survive termination.
26. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOTED AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."
ROOTED DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, ROOTED DOES NOT WARRANT THAT:
- THE SERVICE WILL ALWAYS BE AVAILABLE;
- THE SERVICE WILL BE ERROR-FREE;
- DATA WILL NEVER BE LOST;
- THIRD-PARTY SERVICES WILL ALWAYS OPERATE;
- CONTENT WILL MEET EVERY USER'S EXPECTATIONS OR THEOLOGICAL VIEWS; OR
- USE OF ROOTED WILL PRODUCE ANY PARTICULAR SPIRITUAL, PERSONAL, OR OTHER RESULT.
Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.
27. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOTED APP, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO ROOTED OR THESE TERMS.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSSES ARISING FROM:
- SERVICE INTERRUPTIONS;
- LOST OR CORRUPTED DATA;
- THIRD-PARTY SERVICE FAILURES;
- USER CONDUCT;
- COMMUNITY CONTENT;
- UNAUTHORIZED ACCOUNT ACCESS;
- RELIANCE ON DEVOTIONAL OR OTHER APP CONTENT; OR
- DECISIONS MADE BASED ON INFORMATION AVAILABLE THROUGH ROOTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOTED'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID FOR ROOTED DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability that cannot lawfully be excluded or limited.
Some jurisdictions provide consumers with rights that cannot be waived by contract. These Terms do not limit those rights.
28. Governing Law
Except to the extent applicable law requires otherwise, these Terms and disputes arising from them are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
The arbitration provisions below are governed by the Federal Arbitration Act to the extent applicable.
29. Binding Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes that qualify for the small-claims exception described below, you and Rooted agree that disputes, claims, or controversies arising out of or relating to these Terms, your Rooted account, your subscription, or your use of the Service will be resolved through binding individual arbitration rather than in court, to the extent permitted by applicable law.
Arbitration will be administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules and Mediation Procedures applicable at the time the arbitration is filed, unless applicable law requires otherwise.
The arbitrator will have authority to resolve disputes concerning the interpretation, applicability, and enforceability of this arbitration agreement, except where applicable law requires a court to decide a particular issue.
The arbitration may take place remotely, by documents, by telephone or video, or in another manner permitted under the applicable AAA rules.
Payment of arbitration filing, administrative, and arbitrator fees will be governed by the applicable AAA Consumer Arbitration Rules and applicable law.
Small-Claims Exception
Either party may bring an individual claim in a small-claims court of competent jurisdiction if the claim qualifies for that court and remains on an individual basis.
Waiver of Jury Trial
To the extent a dispute is subject to arbitration, you and Rooted waive the right to have that dispute decided by a judge or jury in court.
30. Class-Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ROOTED AGREE THAT CLAIMS WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS.
Neither you nor Rooted may bring or participate in a class action, class arbitration, representative action, consolidated action, or similar proceeding on behalf of other persons with respect to claims subject to this arbitration agreement.
An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim, except where applicable law requires otherwise.
If applicable law makes a portion of this class-action waiver unenforceable, that portion will be treated in accordance with applicable law without invalidating the remainder of these Terms to the greatest extent legally permitted.
31. Arbitration Opt-Out
You may opt out of the arbitration agreement in Sections 29 and 30 by notifying Rooted within 30 days after the date you first agree to these Terms.

Your notice must clearly state that you are opting out of the arbitration agreement and must include sufficient information to identify your Rooted account, such as your name and the email address associated with the account.
Opting out of arbitration does not terminate your Rooted account or affect your ability to use the Service.
If you validly opt out, neither you nor Rooted will be bound by the arbitration provisions for disputes covered by that opt-out, but the remaining provisions of these Terms will continue to apply.
32. Non-Arbitrable Disputes
If a dispute is not subject to arbitration, or if you validly opt out of arbitration, the dispute may be brought in a court of competent jurisdiction, subject to applicable law.
To the extent legally permitted, you and Rooted consent to jurisdiction in the state or federal courts located in Missouri for such disputes.
Nothing in these Terms prevents either party from using an eligible small-claims court as provided above.
33. Changes to These Terms
Rooted may update these Terms from time to time.
When we make material changes, we will provide notice by email where reasonably required or appropriate.
The updated Terms will state their effective or last-updated date.
Except where applicable law requires affirmative consent, your continued use of Rooted after updated Terms become effective constitutes acceptance of the updated Terms.
For changes that applicable law requires you to affirmatively accept—or where the nature of the change reasonably warrants affirmative acceptance—Rooted may require you to accept the revised Terms before continuing to use some or all of the Service.
34. Assignment
You may not assign or transfer your rights or obligations under these Terms without Rooted's prior written consent.
Rooted may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, asset sale, corporate restructuring, or similar transaction, subject to applicable law.
35. Force Majeure
Rooted will not be responsible for delay or failure to perform obligations caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, government action, labor disruptions, internet or telecommunications failures, cloud-service outages, cyberattacks, utility failures, epidemics, pandemics, app-store disruptions, or similar events.
This provision does not eliminate obligations that cannot lawfully be limited.
36. No Partnership or Agency
Nothing in these Terms creates an employment, partnership, joint venture, franchise, fiduciary, or agency relationship between you and Rooted.
Ordinary users, challenge administrators, churches, ministries, Mission Partners, and other community participants do not have authority to bind Rooted unless Rooted has separately authorized them in writing.
37. No Waiver
If Rooted does not immediately enforce a provision of these Terms, that does not waive Rooted's right to enforce the provision later.
A waiver is effective only if made in writing by an authorized representative of Rooted.
38. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary, and the remaining provisions will remain in effect.
The arbitration and class-action provisions are also subject to any specific severability requirements imposed by applicable law.
39. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly presented for a particular Rooted feature, promotion, or service, constitute the agreement between you and Rooted concerning your use of the Service.
Separate written agreements may apply to Mission Partners, vendors, licensors, charitable organizations, contractors, or other business relationships and are not governed solely by these consumer Terms.
